The owners of Millcreek Mall have filed a lawsuit against Pennsylvania Gov. Tom Wolf and Secretary of Health Dr. Rachel Levine.
According to a statement from the Cafaro Company, The suit demands the mall be allowed to operate and says “This arbitrary decision by the state flies in the face of all logic, reason and fairness”
The suit seeks to prohibit the Governor and Dr. Levine from acting in what it calls an "arbitrary and capricious manner."
Most retailers in Erie County were permitted to reopen May 8th, as the county entered the yellow phase, but the Millcreek Mall was prohibited from opening because the state determined “enclosed malls” were not eligible.
